Cookies used for any of the following purposes are exempt from compliance with the obligations established in article 22.2 of Law 34/2002, of 11 July, on information society services and electronic commerce, hereinafter LSSI:

  • Only allow communication between the user’s computer and the network.
  • Strictly to provide a service expressly requested by the user.

In this sense, the Article 29 Working Group in its Opinion 4/2012 (Opinion 4/2012 on the exemption of Cookies from the consent requirement, http://ec.europa.eu/justice/data-protection/article-29/documentation/opinion-recommendation/files/2012/wp194_es.pdf) has interpreted that among the exempted cookies would be those that have the following purposes:

  • “user input” cookies
  • User authentication or identification cookies (session cookies only).
  • User security cookies
  • Media player session cookies
  • Session cookies for load balancing
  • User interface customisation cookies
  • Social content sharing plug-in cookies

Thus, it can be understood that these cookies are excluded from the scope of application of article 22.2 of the LSSI, and therefore, it would not be necessary to inform or obtain consent for their use.
